What are my father's right in property if he was to file a divorce?

Answered by attorney John E. Kirchner (Unclaimed Profile)
Divorce lawyer at John E. Kirchner
First, as the child you should not get involved taking sides in what is solely a matter between your parents - no good will come of that. Second, your father needs to consult an attorney (alone) to learn more about the divorce process and the legal principles that will govern the financial results of a divorce. There are no simple rules and every case is decided upon what is fair on the facts of that particular situation. Each spouse will be entitled to a fair share of all the marital property; if they cannot agree on what is "fair" a judge will have to make that decision. The only explanation for "fighting" is the parties' own emotional stability and an inability to rationally discuss a fair outcome.

I'm married but separated and we only have one vehicle. He has cancer and is on disability and so isy son who lives with him. He told me to move out

Answered by attorney Cindy S. Vova
Divorce lawyer at Law Offices of Cindy S. Vova, P.A.
Dear Ms. Bunce: As you are still married, the vehicle is the property of both parties, regardless of how it is titled.  Thus, your husband cannot legally stop you from using the vehicle.  You stated you need it for your job, which is fine, but since there is only one vehicle you both need to be cognisant of the other party's need to use the car sometimes. Best of luck, Cindy S. Vova Law Offices of Cindy S. Vova, P.A. Broward/Miami-Dade:  954-316-3496 Boca Raton/Palm Beach: 561-962-2785

Can I solicit child support if I make $98K and he makes $95K?

Answered by attorney Robert E McCall (Unclaimed Profile)
Divorce lawyer at Law Office of Robert E. McCall
Florida has no jurisdiction to take any action upon DOM until the child has been in state for at least 181 days. In Florida it is mandatory for the court to address child support as part of the DOM. Amount of parties income is irrelevant in Florida, CH is set by a mathematical formula by the Judge.
