Unless there is a Court order which requires you to leave the residence or it is unsafe for you to reside there, it is not necessary to leave the residence.  Just because your wife has commenced a divorce does not mean you have to leave.  During the pendency of a divorce action, the Court will only order you to leave the residence if you have voluntarily set up an alternative place to live OR if it is improper and unsafe for you and your wife to live together.  This generally means that unless there is violence between you and your wife, you can stay in the residence.  There are circumstances under which spouses have been ordered to vacate the residence during a divorce without violence where there has been severe mental cruelty but those are not common. You should review your circumstance with an experienced matrimonial attorney in your area before undertaking any action such as vacating your residence. - Alfred Polizzotto, III

Probably wrong but not a crime, needs to be addressed in your answer. Florida has a three year look back provision that allows a party to review financial matters for the past three years.
