If you do not want an attorney (which may be a mistake if he will fight to have the children), then apply for the services of the child support office in your county, so you can at least establish the child support or family support.

I strongly suggest you have a face to face consultation with a family law attorney because there is no reason the rental income should not be considered in setting support. A family law attorney can also tell you how to get the case finalized. If you are not happy with your current attorney, you can change attorneys at any time. But I would discuss this with your current attorney before making any changes and I would make sure you like the new attorney before making a change.

That is very difficult to answer based on that information. At the least, you would be entitled to seek an equitable division of property, if there is any marital property owned between you. A court would look at factors like the income of both parties and the conduct of the parties during the marriage. It is also not clear what you would be asking in regards to custody of the child and/or child support. If you are serious about seeking a divorce, you should probably contact a lawyer to go into more detail with and get further advice.
