Do we have to annul the first marriage and remarry to validate our marriage if I remarried 2 months before receiving divorce decree?

Robert Jensen 'Bob' Matlock
Answered by attorney Robert Jensen 'Bob' Matlock (Unclaimed Profile)
Divorce lawyer at Mackoy, Hernandez, Jones and Woods LLP
If the first marriage resulted in a valid divorce, the second marriage became valid upon the entry of the divorce orders. I suggest you consult with a lawyer to examine the paperwork to be sure.

Is the separate property for my wife or community property?

Kimberly Demetrice French
Answered by attorney Kimberly Demetrice French (Unclaimed Profile)
Divorce lawyer at Law Offices of Kimberly D. Moss, PLLC
The house that your wife purchased is her separate property; however, any payments you made toward the mortgage or to the improve the home are subject to a reimbursement claim back to you because you contributed to her separate property by making payments. The 401(k) from her job may be separate or community property depending on when she started her employment. Any contributions to the 401(k) plan prior to your marriage are separate property. Contributions after the marriage are community property, whether she made the contributions or you did. In any case, any income from any source (including retirement account contributions) are community property as of the date of your marriage. I highly recommend scheduling a consultation with a local family law attorney to discuss your rights and options in your case.

Can my husband keep my truck if it was bought if my inheritance and is only in my name.

Answered by attorney Renea Overstreet
Divorce lawyer at The Overstreet Law Firm
Your inheritance is your separate property. Anything you buy with your inheritance is also your separate property. You have zero obligation to give your husband the truck or any money from your inheritance. If you were to get a divorce, the court would not award your husband the truck or the money from your inheritance. You should keep your inheritance money separate from any joint account because that will help prove that it is your separate, inherited property.
