Is one legally entitled to spouse inheritance?

Answered by attorney Monica H. Donaldson Stewart
Divorce lawyer at Donaldson Stewart, P.C.
Any property acquired during the marriage is community property, subject to division in a divorce, and property acquired prior to marriage is separate property (not subject to division). Some exceptions: inheritance received during the marriage is presumed to be separate property unless it is combined with community property (e.g. deposited in a joint account); also, if you owned a home prior to marriage and added your spouse to the deed, the house has likely become community property. I recommend you consult with an attorney to discuss this matter in greater detail.

What can be done if I was awarded half of my ex's 401k but I found out he borrowed all the money?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
Divorce lawyer at Richard B. Jacobson Associates, LLC
Your best remedy is to seek to have him held in contempt of courtif, as seems likely, he borrowed the money in order to undermine the division of property set forth in the marital settlement agreement or judgment of divorce. If he borrowed the money earlier, but did not disclose the debt on his final Financial Disclosure Statement, you have a similar remedy.

Can I refile my divorce in another state?

default-avatar
Answered by attorney Joanna Marie Mitchell (Unclaimed Profile)
Divorce lawyer at Joanna Mitchell & Associates, P.A.
If your prior petition was dismissed, then you are not divorced. If you meet residency requirements in the State that you currently reside, then it may be possible for you to file there. You should consult with an attorney in order to determine what State has jurisdiction over your divorce matter, as well as any issues pertaining to minor children, if you have them.
