Ogborn Mihm LLP is a firm of seasoned trial lawyers based in Denver, Colorado. Founded by three former presidents of the Colorado Trial Lawyers Association, the firm focuses on high-stakes business and professional liability litigation likely to go to trial. Ogborn Mihm is one of the few law firms in the United States that specializes in representing plaintiffs in legal malpractice lawsuits. The firm has obtained some of the largest jury verdicts and settlements in legal malpractice cases in the United States. When undertaking a client's cause, the firm's trial teams focus on working up the case to best prepare it for trial, but always with a goal of controlling costs and resolving the case to the client's satisfaction before trial if possible. To that end, the firm includes the client in the case planning at every step of the process. The firm's goal is to quickly respond to clients' questions and concerns and address their practical business needs. On significant cases, the firm uses trial consultants, jury focus groups and other cutting-edge trial techniques and technology to prepare the case for trial. Members of the firm serve as trial consultants and conduct jury research for other law firms.

The firm's clients are mostly entrepreneurs and closely-held businesses, however, its clients range from individuals to Fortune100 companies. Most of the firm's referrals come from other lawyers, with a significant portion of those referrals coming from clients' in-house counsel or outside general counsel. The firm serves clients in state and federal courts throughout the United States, with a significant portion of its cases in the Rocky Mountain west and Midwest.

  • Representative Clients

    Legal Malpractice – Breach of Fiduciary Duty / Corporate Control – $2.5 Million Jury Verdict. Ogborn Mihm represented the owners of one of Colorado's most prominent retail businesses in a legal malpractice lawsuit against the owners' former lawyer. The lawyer had secretly worked with disgruntled family members in an attempt to seize control of the company, resulting in expensive litigation. In April 2014, after 9-day trial, a Denver jury awarded $2.5 million to the firm's clients. Deborah Shpall, et al. v. Jay Chapman, Esq., et al., Case No. 2013CV32307, District Court, City and County of Denver, State of Colorado.

    Legal Malpractice – Land Use Application – $12.8 Million Jury Verdict. After a national law firm mishandled a client's subdivision application for an 8,600-acre ranch near Park City, Utah, causing the client to lose 40% of its density rights, the client retained Ogborn Mihm to pursue a legal malpractice claim. After a 14-day trial, a Salt Lake City jury awarded all of the $21.36 million requested at trial, but assessed 40% comparative fault to the client, thus reducing the award to $12.8 million. The trial court later awarded the client an additional $1.46 million for prejudgment interest, for a total judgment of more than $14.2 million. 910 Cattle Company v.     Utility Overcharges - $12.5 Million Jury Verdict. When a client steel company discovered that a utility had overcharged for electricity by many millions of dollars, Murray Ogborn recovered a $12.5 million jury verdict after a six-week trial in the U.S. District Court in Nebraska. Nucor Steel v. Nebraska Public Power District.
