What will happen if I violated DUI probation?

Answered by attorney Andrew Stephen Roberts
Criminal Law lawyer at Roberts Law Group
For a violation of probation the Judge could revoke your probation; sentence you to jail; make you attend more alcohol classes; suspend your license- or any combination of the above. Get an attorney. This can be dealt with.

Is it legal for a 35 year old to have relationship with a 17 year old?

Jared Clayton Austin
Answered by attorney Jared Clayton Austin (Unclaimed Profile)
Criminal Law lawyer at Austin Legal Services, PLC
There is nothing illegal about the relationship since the age of consent in Michigan is 16 unless it falls under one of the exceptions such as he is your teacher, relative, you are a mentally incapacitated person, etc. However, just because it is legal doesn't necessarily mean it is a good idea. Think it through very thoroughly and talk it over with someone you trust before becoming too serious or committed.

Will my friend be looking at jail time?

default-avatar
Answered by attorney Terry Alan Nelson (Unclaimed Profile)
Criminal Law lawyer at Nelson & Lawless
What will happen to him go to jail The honest answer is that no attorney can predict the outcome, nor even give an intelligent opinion, without reviewing and knowing all the charges, evidence, police reports, expected testimony, priors history, etc. Every crime carries potential jail or prison upon conviction. The charges actually filed by the prosecutor will determine how much time could potentially be imposed. In California, if convicted of any felony, you potentially face one or more years in prison, plus fines; on any misdemeanor, you potentially face up to 12 months in jail, plus fines. Priors and strikes will add formal penalty enhancements and affect the prosecutor and judge attitude toward you. If this constitutes a probation violation, factor those new violation charge[s] and old deferred sentence[s] in as well. You'll learn the actual charge[s] filed and any enhancements, priors, or violations alleged, and get copies of all the police reports and prosecutors evidence when appearing for arraignment at the first court hearing. No amount of free 'tips and hints' from here or elsewhere are going to effectively help in a legal defense. If you don't know how to represent yourself effectively against an experienced prosecutor intending to convict, then hire an attorney who does, who will try to get a dismissal, charge reduction, diversion, programs, or other decent outcome through motions, plea bargain, or take it to trial if appropriate. The police, prosecutors and judges in the justice system do not like people attacking police, so treat this seriously. If he is serious about hiring counsel to help in this, and if this is in SoCal courts, feel free to contact me.
