You may try filing a complaint with the internal affairs. If that does not work you may have to hire a lawyer who could hire a private investigator to conduct surveillance. You should have a lawyer hire the investigator because it would be less of a problem if the cop sees the p.i. and tries to charge you and the p.i with stalking or interfering with an officer.

It depends on what you allegedly stole and it's value. Generally, if the items allegedly taken were less that $950 then it is considered "petty theft," a misdemeanor, the possible punishment for which is 6 months in county jail and/or a $1,000 fine. If the value is greater than that it is grand theft for which you theoretically be sentenced as a county-jail-felony under the Realignment laws. In most instances, a burglary is also charged when you enter a store to take something, which can be a felony regardless of what was taken.
