Even if your Criminal DUI case was dismissed, the DMV can still suspend your license based on a DMV hearing loss (or failure to request a DMV hearing within 10 days). It may be possible to have a rehearing on the matter since the criminal case was dismissed though. You may want contact an attorney in your area that is familiar with DMV hearings to petition the DMV for a re-hearing (or late hearing request). Also, keep in mind that if it is a first offense DUI (and all criminal charges were dismissed) you should only be required to do an alcohol class from the dmv if you want to get a restricted license. If you sit out the 4 month hard suspension (again based on 1st DUI), then you should be able to get your full license reinstated after that.

Not everyone who commits a crime goes to jail. His history and your input will impact what the court orders. In domestic violence situations the court does not want to split families up who are trying to work things out. They will want the offender to remain sober and engage in counseling, both substance abuse and domestic violence, to ensure that repeated behavior does not happen.
