Yes, he can be. It is possible for 2 people to be in possession of a single supply of drugs, and if the police and prosecutor believe your friend was in possession as well, then he can be charged. He should hire a lawyer; he has a good defense that the other person was the only person in possession.

They may have provoked him, but he still had the option of not engaging in it. The choice was his. You can consult with a civil firm that does a lot of ciivl suits for a second opinion, but I don't see any grounds there for a suit.
