How can I get my license back?

Answered by attorney Philip Daniel Hache
Criminal Law lawyer at Law Offices of Phil Hache
Did the DMV still suspend your license based on an APS ruling (or your failure to request an APS hearing)? If so, you still may be eligible for a restricted license until that suspension runs its course. Was this a first DUI, or did you have priors?

What do I do if my court paper says I have a court date but the circuit clerk says I don’t?

If your citation/arrest papers state that you have a court date on 3/25, I would suggest that you be in court on that date. It is possible that charges have not been filed with the court yet and may not be actually filed with the court until the 24th or even the 25th. If on the 25th there is no record of any filings, have the clerk stamp your paperwork, showing that you did appear as ordered on the arrest papers.

How can I not have a record after confessing that I stole $700?

Mark A. Broughton

If charges were actually filed you should have a criminal defense attorney to represent you. In that instance, and because it involved public funds, it will be difficult to get a complete dismissal but it is not impossible since you paid back the funds. The best scenario is if the case is not filed by the DA; and attorney can assist before the case if filed as well. Bear in mind that even if the case is dismissed there will be a record of the case that will probably be discoverable on most background checks. It should show the dismissal, but the fact that you were charged with this offense will be something that you will no doubt have to deal with in the future.
