Is he in on something else? 5 years pre-trial is a very long time. There must have been a reason. If the lawyer won't speak to you then perhaps it is time to hire a new lawyer.

Without seeing the police report, there is no way to know what "proof" the police have. I have had clients who refuse to believe that eye-witness testimony is evidence, because it is their word against the witness's. But that testimony is evidence, and the judge or jury decides who to believe.
