My boyfriend is being charged with battery, I never said I wanted to press charges now he is locked up, what can we do?

Answered by attorney Philip Daniel Hache

Did you call the cops on him initially, then changed your mind when they arrived at your door (or something similar to that)? Or was it someone else that initially contacted the police regarding a disturbance of sorts? Whatever the situation, the prosecutor can try to move forward with the case even if you do not want to. Your boyfriend should contact a criminal defense attorney in your area who may be able to get involved in the case, to mitigate consequences and potentially get charges dismissed.

Yes, you could be charged with a crime.  You would be charged, at a minimum as an accomplice or conspirator.  Whether anyone (DA, Jury, etc.) beleived you thought it was okay is a question that will repeatedly come up. However, if you mother confesses to telling you to do it, it might help you and make it easier to work out a plea bargain that is favorable too you - IF you get charged.

My son received his 2nd MIP ticket in Colorado, will he lose his license?

Gregory Charles Graf

The statute says that he will lose his license but, it can be avoided through the plea bargaining process. There are a number of plea bargains that can be reached that will avoid this outcome. Further, some jurisdictions will not report the case to DMV. I suggest you hire counsel to help you through this process.
