The laws surrounding the 4th Amendment and whether or not search is lawful is largely dependent on ALL of the facts and circumstances surrounding the search of your car. In order to score her pursuant to the Florida Sentencing Guidelines, one needs to know the precise charges that she is now facing, the facts, and the entire past criminal record. Without knowing these matters we can only guess what the score will be, and what a sentence to DOC could be. Along with knowing these things it is also helpful to know the State Attorney and the Judge. Castle Rock is in Colorado, but this question is asked of Florida attorneys. Florida attorneys do not know the criminal laws of Colorado, unless they are also licensed in that state. People should not expect that there will be accurate answers to questions that contain no real facts asked to lawyers who do not practice in the state where a defendant is charged with crime. My objective if this were a Florida case would be no DOC time, to get the best possible deal after investigating all of the facts of the crime charged and determining that there was no chance of winning at trial. Reasonable doubt can be and often is pulled out of thin air. Juries actually sometimes listen, and you frequently have to pick a jury before a reasonable and acceptable plea offer comes from the State.
