It may be brought as a 3rd degree, 5 year felony. It could be resolved with a few years of probation, but you will need to retain private counsel for the very best result.

What is my boyfriend looking at for a Breaking & Entering charge?

Criminal Law lawyer at Marco Caviglia, Esq.
I am assuming that he is convicted of Burglary 2d, a C violent felony, which is mandatory prison for a number of years between 3 1/2 to 15 years. If he plead guilty, he knows exactly what the sentence will be pursuant to a plea bargain, so contact his lawyer.

Withdrawal of complaint and release would probably mean that the case is over, that the state is dropping it, which is usually termed a nolle prosequi.
