Since one is innocent until proven guilty, questions about arrests are unconstitutional and you can honestly state that you have no criminal convictions. More importantly, you should hire a lawyer to Petition to Expunge your old arrest a.s.a.p. so that this is never an obstacle again.

You could possibly be prosecuted, you will just have to wait and see if Walmart turns it in to the cops. I would just start shopping at Target and Big Lots.

Yes, she can report it to the police. She does not "press charges." The District Attorney's office will decide if they want to prosecute. It is not up to your girlfriend or her mother to prosecute once a police report is filed.
