What is the most likely sentence for an 18 year old who got caught selling 1 oz of weed to a minor and during school?

default-avatar
Answered by attorney Robert Jason De Groot (Unclaimed Profile)
Criminal Law lawyer at R. Jason de Groot, P.A.
It could be up to five years in prison. That would be the maximum, and I would have to know much more than was given in a few sentences. But a most likely sentence would be at around 2-3 years of probation.

In this case, did theft actually occur even though we never left the scene?

Answered by attorney Nathaniel D Shafer
Criminal Law lawyer at Natty Shafer Law
Theft depends largely on what you intended. You have a good argument that you never intended to steal anything. Your friend was the one arguing, and the cabbie called the police before anything could be resolved. Hire a lawyer to help you make the argument, and your chances of an acquittal or a dismissal will improve.

Can police pull you over and search your vehicle because you were leaving a felon who did not have a warrant home?

Answered by attorney Robert Jason De Groot (Unclaimed Profile)
Criminal Law lawyer at R. Jason de Groot, P.A.
We have to know the reasons for the stop and search as stated in the police report, not just what you think was done. No, they cannot just stop you for leaving a place where a convicted felon lives.
