My initial thought is that not all jury instructions finally given to the jury match the proposed jury instructions initially submitted. Often, following submission of the initially proposed jury instructions, changes are made due to objections, motions, and legal argument to the court.  However, there may be an issue if, following proposed written jury instructions and the court's rulings in response to any objections, motions, and legal argument on the jury instructions, the instructions given to the jury do not correspond to the court's final rulings with regard to the instructions to be used.  But to know if there's a problem, you would need to compare not only the proposed jury instructions with the ones finally given, but would also need to review a complete transcript of all motions, objections, argument and rulings pertaining to the proposed jury instructions.  Standard procedure is for the attorneys for both sides to have a copy of the jury instructions as the judge reads them to the jury.  Consequently, if the instructions were incorrect or unilaterally changed, the defense attorney normally would notice it and object during the jury instruction phase.  If, indeed, there was an unilateral change and no objection, there could be an issue of ineffective assistance of counsel.  However, failure to notice and object to a change will not automatically bring about a new trial or different result.

The arrest for battery is not a violation of probation, unless and until the charges are proven at a violation of probation hearing. He does not have to be convicted of the battery charges. He only needs to be found guilty of violating his probation by committing the act of simple battery.

You shouldn't go to jail if you tell the truth. It is possible, but not likely. It is far more likely that he will go to jail if he was already on probation for the same thing. Get a lawyer asap and explain it to him/her. It sounds like you don't want him to go to jail and I can understand both that and your anger for him cheating. But get a lawyer to you can both avoid jail.
