It really depends on the judge and what the prosecutor is asking for it. Even for a first offense, for some judges domestic violence is a very serious offense and will give some jail time. He may qualify for a deferred sentencing option known as 769, which would help him earn a non public record upon successful completion of probation. He should at least consult with and seriously consider retaining an experienced criminal attorney in the area to review his case, options, and likely outcomes.
