The good news is yes it can be expunged; the bad news is not quite yet. You have to wait at least 5 years from the date of the conviction before you can petition to have a conviction set aside.

If you were given a court date and did not appear in court, there is no Statute of Limitation on your case. In fact, you probably have a bench warrant issued against you by the judge for your failure to appear in court. I strongly suggest that you contact an experienced criminal defense attorney immediately for a face-to-face consultation and give him/her all of the facts surrounding your arrest and case. He/she would then be in a better position to analyze you case and advise you of your options.
