If the defendant is represented by an attorney and the domestic violence is filed as a misdemeanor, the attorney can make the appearance for the defendant pursuant to Public Code section 977(a) without the defendant being present. If the case is filed as a felony or the defendant is not represented by an attorney, the defendant must appear in court.

Your question starts with "four years" but then says "four months". If it's only been 4 months, then that's not necessarily time to worry. Many DA's offices are backlogged and it may take them 6 months to get to your case. Besides - why are you in such a rush to get charges filed against you? If it goes longer than a year, the statute of limitations runs out and they can't go forward. If it has been 4 years, the statute of limitations is way past and the prosecution cannot file charge against you. Either way, you should be discussing this with the attorney you hired.
