Can my attorney charge me extra if I got a deferred adjudicated probation?

Answered by attorney Mark R. Thiessen
Criminal Law lawyer at Thiessen Law Firm
That is very cheap, so I don't think he'd come after you. Really it's up to you. The case is done. But if you agreed to pay him, then pay him. Deferred is still a great result. No one can guarantee a dismissal. Makes me wonder about the quality of your attorney though, charging $100 and promising dismissals.

How long can they keep my wife in jail?

Cynthia Russell Henley
Answered by attorney Cynthia Russell Henley (Unclaimed Profile)
Criminal Law lawyer at Cynthia Henley
She obviously has been charged. If she was charged with a felony, they have 90 days to indict her or give her a bond she can make. My guess is, though, that she has been indicted given the amount of time between the execution of the warrant and the arrest. She will remain in jail until her case is settled or someone bonds her out. If she is indigent, she will get a court appointed lawyer. If she is not, then she needs to hire a lawyer (which is best.)

Can I get a DUI while driving on private property?

Answered by attorney Matthew G McHenry
Criminal Law lawyer at Levine & McHenry LLC
Technically no-one of the elements of a DUII charge is that the vehicle be operated on a public highway or a place that the public has access to. That being said, you could be charged with "Attempted DUII," a charge the Oregon Court of Appeals recently confirmed is valid. The state may try to prove that even though you were on private property at the time, you intended to drive onto public property. Not saying the state would win, but it is something to be aware of.
