If you are indigent and charged with a misdemeanor or felony, you are entitled to be represented by counsel. If you cannot afford private counsel, the Court will appoint a lawyer for you. At your next court date, you should advise the Judge that you cannot afford a lawyer. The Judge will have you fill out a form or application listing your income, assets, and debts. Upon reviewing the application, if the Court finds that you are indigent and without resources to pay for a private lawyer, the Court will appoint you a lawyer. In most instances, the Public Defender\\\'s office will be appointed to represent you. However, if your case involves more than one defendant, and the Public Defender\\\'s office is representing someone else charged in your case, the Court will appoint you a lawyer from a list of private lawyers who have agreed to represent people at reduced rates. The Court will pay the lawyer directly. For matters other than misdemeanors, such as petty offenses or traffic tickets, you most likely will not be eligible for appointed counsel, but you should ask the Judge because the rules vary from state to state.
