Do not pay the $325 let them try to sue you in civil courts, small claims. Most judges will not give them anywhere near $325. Get a lawyer for the criminal case, private or public defender. They may be able to avoid the theft conviction through plea bargaining. A theft can be a problem for the rest of your life so you need a lawyer.

You can't. It doesn't work that way. If you are requesting a civil trial, that means you are suing someone. In a criminal case, the district attorney's office presses charges against somebody.
