If a person rents a motel room in his name and police find drugs in the room but he was not there, can he be charged?

Answered by attorney Robert Jason De Groot (Unclaimed Profile)
Criminal Law lawyer at R. Jason de Groot, P.A.
There are a lot more facts involved in this than what you have written. A criminal defense attorney will read all of the police reports and witness statements, and might even conduct depositions to learn all of the facts and circumstances. There are many questions that need to be asked. Who else had access to the motel room? Who else had a key? Who was with the defendant when he rented the room? How did they arrive? Was the defendant familiar with the area?

A permanent restraining order is a permanent restraining order. More facts are needed in order to tell you what I think should be done. This is not a criminal question, is it?

Can the police stop that kid on the street for attempted robbery, search him and arrest him?

Answered by attorney Jason William Savela
Criminal Law lawyer at The Savela Law Firm, P.C.
The stop must be based on something identifying the person stopped, clothing description, general description or approximate location. Police cannot just stop everyone and search them.
