Is it too late to drop the charges against my boyfriend?

Mark A. Broughton
Answered by attorney Mark A. Broughton (Unclaimed Profile)
Criminal Law lawyer at Mark A. Broughton, PC
A citizen/"victim" does not prosecute, or "drop charges." That decision is entirely up to the DA (prosecutor). And this happens so often in domestic violence cases that there is a special code section dealing with it. So no, you cannot drop charges.

What is the penalty for writing back checks and cashing them?

Answered by attorney Aaron Michael Black
Criminal Law lawyer at Law Office of Aaron M. Black, PLLC
This could be many things in Arizona. The most common would be Forgery, a class 4 felony. However, depending on what the police know there could be additional charges for theft. If the checks were written on two separate days, or there were two separate transactions the state can allege this as two distinct and separate crimes making it prison mandatory if you are convicted after trial. If you have no prior felonies you would be looking at probation on the first check and 2.25 - 7.5 years in prison on the second check - if charged as a class 4 felony for forgery. You need to stop posting on pubic websites and retain counsel.

Can I defended myself if attacked by minors and to what level can I restrain if I feel threatened?

The actions which you have described are violations of the law, namely racial intimidation and common-law assault. It is illegal to place anyone in fear of physical harm or death. You have a right to self-defense and are allowed to use reasonable force in order defend yourself (and your child). I would suggest that the next time this occurs you should, you can take a photograph of the perpetrators and call 911.
