Should I proceed with going to court to get verification of records?

Answered by attorney Jared Christian Winter (Unclaimed Profile)
Criminal Law lawyer at Law Office of Jared C. Winter
I think that's a good step to take, but you should bear in mind that the DMV governs licenses, not the courts. So, if the case was dismissed in the courts, that does not automatically put you in the clear with the DMV. If you blew a .08 or greater at the time of your arrest, it's possible that the DMV is going to insist that you complete the DUI courses, regardless of what happened in the courts.

What constitutes an illegal search and seizure of your home?

Answered by attorney Paul J. Wallin
Criminal Law lawyer at Wallin & Klarich, A Law Corporation
There is no law that the police must allow you to observe how they search your house. Most often police will have you placed in custody in a police car while they search. They will claim it is for their safety but of course they do not want witnesses to how they search. Often the police will ransack a home when there is no lawful excuse for them doing so. Whether the search of your home was legal will depend upon many factual issues. You need to contact an experienced criminal defense law firm who can review the facts of your case with you and decide if the search was in fact unlawful. If a court finds the search unlawful then the evidence could be thrown out of court against you.

What can I expect if I am accused of theft?

Answered by attorney Terry Alan Nelson (Unclaimed Profile)
Criminal Law lawyer at Nelson & Lawless
Her rights are to defend any criminal charges. What can you do? Hire an attorney, unless you know how to effectively represent yourself in court against a professional prosecutor intending to convict. No amount of free 'tips and hints' from here or anywhere else are going to effectively help you in your defense. A little free advice: exercise the 5th Amendment right to SHUT UP and do NOT talk to anyone except an attorney about the case. That includes on this or any other web site or public forum. It also includes any communication or dealings with the store agents. Most police and prosecutors will happily tell you that 95% of people convict themselves by trying to be 'helpful and cooperative', either during initial contact, questioning, interview or interrogation. If serious about hiring counsel to help in this, and if this is in SoCal courts, feel free to contact me. If you havent yet been arrested, or at least havent yet gone to court, your attorney may be able to negotiate a civil compromise agreement with the store that will avoid you being prosecuted.
