The penalty for violating probation is the penalty for the underlying charge that you were on probation for originally. So, if you were on probation for Larceny Over $250 that bears a maximum penalty of up to 2.5 years in the house of correction, a violation of that probation allows the judge, upon a finding that your boyfriend did in fact violate, to sentence him to anything from nothing to 2.5 years in the House of Correction. A new charge is a violation since the very first term of every probation is to not get into further criminal trouble. Now, having said that, although the court can sentence up to the max of the underlying crime, it is rare that they do. It will depend on a lot of other factors such as, his previous criminal history, how he did with other terms of probation, and how good his lawyer is.
