Is it breaking and entering of a personal locker on company property?

Answered by attorney Mark R. Thiessen
Criminal Law lawyer at Thiessen Law Firm
Depends on the rules of the company. It's gonna be a tricky issue on whether you have an expectation of privacy in a personal locker. Kids don't at school. And it's property owned by the company. It's going to be very fact specific and ultimately come down to the Judge.

What is the penalty for breaking probation by living in a different county than the one you were registered in?

Gregory Casale
Answered by attorney Gregory Casale (Unclaimed Profile)
Criminal Law lawyer at Gregory Casale, Attorney at Law
The penalty for violating probation is the penalty for the underlying charge that you were on probation for originally. So, if you were on probation for Larceny Over $250 that bears a maximum penalty of up to 2.5 years in the house of correction, a violation of that probation allows the judge, upon a finding that your boyfriend did in fact violate, to sentence him to anything from nothing to 2.5 years in the House of Correction. A new charge is a violation since the very first term of every probation is to not get into further criminal trouble. Now, having said that, although the court can sentence up to the max of the underlying crime, it is rare that they do. It will depend on a lot of other factors such as, his previous criminal history, how he did with other terms of probation, and how good his lawyer is.
