Will my two theft convictions show up on a background check after 7 years?

Cynthia Russell Henley
Answered by attorney Cynthia Russell Henley (Unclaimed Profile)
Criminal Law lawyer at Cynthia Henley
It is public record so if the company checks themselves then they can find it. If it is checked by an outside company, they are limited to reporting cases 7 years or less.

Is it legal for our offices to be checked by law enforcement?

Answered by attorney Shannon Willis Locke
Criminal Law lawyer at The Locke Law Group
You have a Constitutional right to be free from an unlawful search and seizure. The police cannot search without a warrant. However, if they get a warrant you have to allow them to search what the warrant allows them to search (but nothing more). The police can always ask permission to search whatever they want to search. If you give them permission to search then they don't need a warrant as you have given up your expectation to privacy. If you have been contacted by the police you need to hire a lawyer. Don't try and make deals by yourself with a police officer. A police officer does not have any authority to make deals with you, and any promises he makes cannot help you later. Good luck and hire a lawyer ASAP.

What can I expect for a class b shoplifting?

Answered by attorney Mark R. Thiessen
Criminal Law lawyer at Thiessen Law Firm
By all means hire an attorney and do not plead guilty. Theft is a crime of moral turpitude and if on your record could prevent you from getting all types of jobs. This is a very serious case. Worst case scenario take deferred adjudication probation and get it sealed. But hopefully a good attorney can get it dismissed.
