Sure, you can sue the person who stole your identity. This is why the cops take mug shots, it wasn't you. The problem with suing the real criminal is that he has no money. It would be a waste of time. Hopefully, the good officer will get this cleared up, and might even be able to charge the real criminal with another crime.
