Can they bring the felony charge into play to revoke the probation that ended for my husband's DWI?

Answered by attorney Stephen Lewis Freeborn (Unclaimed Profile)
Criminal Law lawyer at Freeborn Law Offices P.S.
Absolutely they can. One of the conditions of your husbands probation for the DWI,, is that he have law abiding behavior and no violations of the law. Now your husband has two violations while on probation. Not sure why he wasn't revoked for the first violation but a second violation. And a felony at that. No question in my mind that he will be revoked.

It depends on who you made the false statement to. If it was a police officer, anyone who files a false police report in California is guilty of a misdemeanor with a potential jail sentence of up to one year.

Can a restraining order be granted without cause?

default-avatar
Answered by attorney Terry Alan Nelson (Unclaimed Profile)
Criminal Law lawyer at Nelson & Lawless
No, legal cause is required, but you disagreeing with the stated reasons does not mean there is no cause. A RO is issued only by a court where the conduct and charged party resides. If serious about hiring counsel to help you in this IF someone actually files for a RO against you in SoCal courts, feel free to contact me.
