I have a question about a score sheet

Answered by attorney Diane Buerger
Criminal Law lawyer at The Buerger Law Firm, P.A.
When a defendant is being sentenced on a felony in Florida, the state must prepare a scoresheet showing the current charge on which he is being sentenced, as well as prior convictions -- and the points assessed for the various convictions.  (Normally a defendant's entire criminal record is on the scoresheet.  However, there are a few limited exceptions.)  A copy of the scoresheet is provided by the state, prior to the sentencing, to the defendant's attorney.   The attorney should review the scoresheet, prior to the imposition of sentencing, with the defendant.  If the scoresheet is incorrect, the Defendant has the right to challenge it and have it corrected.  If the state provided a scoresheet early on in the case (i.e., prior to a trial or entry of a guilty or no contest plea), the Defendant should tell his attorney about any errors on the scoresheet.  His attorney should be able to either explain why the scoresheet is correct -- or explain the process for getting it corrected before the Defendant is sentenced (if he either is convicted at trial or as the result of a plea bargain).

So what is the defense going to be?   I only sold him .4. Therefore, I am not guilty.   You need to retain an attorney. That defense does not work

Will my nephew serve prison time for a second degree burglary and fourth degree grand larceny?

This is not a question for a California lawyer, there are no degrees of larceny in CA, talk to a lawyer in your state.
