That very much depends on which judge is assigned to your case and which prosecutor is involved. They all have different prosecution/sentencing policies. Who is your judge?

Can I press assault charges against my neighbor?

Edward J. Dimon
Answered by attorney Edward J. Dimon (Unclaimed Profile)
Criminal Law lawyer at Edward J. Dimon
You can press charges against your neighbor for harassment and terroristic threats. you can press charges against your neighbor for harassment and terroristic threats   However, to avoid being frustrated by the process, I would make sure that I have sworn statements from all of the witnesses setting for us sufficient criteria to prove both harassment and terroristic threats.  You can utilize our private investigator to interview the witnesses and take sworn statements. If our investigator is of the opinion that you have the proof  of harassment and terroristic threats, then you can decide if you want to hire one of our attorneys as your private prosecutor. I would recommend Valter Must, Esq.  if you do not use a private prosecutor, you'll be frustrated by the system in that the public prosecutor will not pursue these charges with any vigor.  Please call to discuss. How can I have the charges of possession of marijuana and petty theft dropped?

Dropped altogether?? Not likely. A good criminal defense lawyer can work something out that will not hurt you assuming you have no prior record. I am a former federal and State prosecutor and now handle criminal defense.
