If you failed to appear for an arraignment and they issued you a warrant then the statute of limitations would be tolled. But you may be able to make other arguments against your prosecution like prosecutorial delay and/or malfeasance. Get a lawyer to examine these issues.

You have a right to get your records, but that doesn't seem to be the question you are asking. Notify both Aspen Dental and your insurance company, in writing, that they are not authorized to charge anything to your insurance. Confirm that they have received the written notice.
