It depends on a number of factors. Resisting arrest can be charged in a variety of ways, so the first question you need to answer is what code section he's actually been charged with (probably either PC 148(a) or PC 69). The second question you need to answer is what charge he's on probation for. The third question you need to answer is how his performance on probation has been? His attorney will have access to all of this information and will be in a far better position to give you an accurate prediction as to how your boyfriend's case will turn out.

If you do not believe that the court appointed attorney is providing adequate legal representation, you can request that the court appoint new counsel. In California, this is done through a Marsden hearing. If you want a new lawyer, that's what needs to be done. That or hire one. But here's some advice. You have listed your three options felony, misdemeanor with payment of a big chunk of restitution, or fight the case. Fighting the case may not be the best option. The fact that you had a "disability case" probably does not give your boyfriend the right to hide the fact that you were residing with him. By fighting the case, simply because you don't like your other two options, you are exposing him to the risk of a worse result (e.g., felony conviction, jail and/or prison time, plus restitution). You may not like your attorney, and no he can't refuse to do work on your case because he thinks he is going to lose. But you may want to more carefully evaluate your options.

The more likely scenario is that the other parent could be charged with negligence and child endangerment for not stopping the abuse. To be an accomplice requires an agreement to commit an illegal act.
