This a contract case and not a criminal law case. Without seeing the contract, it's hard to judge if it will hold up in court, but what you described has the potential to be upheld.

That amount would place him at the felony threshold and therefore he is facing potential prison time. However, if it is his first offense, that is extremely unlikely and almost assuredly will not happen. Probably the worst case scenario is he would be placed on probation. If he is eligible for a diversion program, that would keep the conviction off of his public record. HYTA would do the same thing. If in doubt, at least have an attorney review his case before he agrees to plead to anything. Of course, these options may not apply if he has a prior record.
