The state has about 30 days to file charges or the defendant must be released on recognizance. But they filed the charges according to what you wrote, so that does not apply now. He can be held until trial. Get an attorney on his side.

Who has told you that you, the victim, have to be at the arraignment? You have to testify in court, if you do not show up, they still might convict, but that depends upon the exact facts. The spouse needs to get a private criminal defense attorney.
