How can I get the DA from imposing a long sentence that would leave us with no job or means of survival?

default-avatar
Answered by attorney Dennis Julian Roberts (Unclaimed Profile)
Criminal Law lawyer at Dennis Roberts A Professional Corporation
Get your own lawyer who can tell the DA that you cannot testify because some of the statements you made in the police report are not completely true - but only do this if in fact some statements are wrong. Usually when people report DV they are pretty shook up or pretty angry and that's how things like erroneous reports happen. Do not try to do this yourself as they will just blow you off. If you cannot or don't testify that ends the case unless he confessed or someone else saw it and is willing to testify. But if he did this twice you should think about dumping him as he will keep doing it.

In a fraudlent use of a debit card, what happens after I do the police report and send it to the bank?

default-avatar
Answered by attorney Francis John Cowhig (Unclaimed Profile)
Criminal Law lawyer at Francis John Cowhig
After you file the police report, the police will probably investigate and if there is enough evidence, they will either arrest your husband on suspicion of theft or submit the report and investigation to the D.A. for filing and issuance of an arrest warrant. As far as the bank is concerned, they may also press charges against your husband.

Should I speak with a nursing board investigator without a lawyer?

Answered by attorney Terry Alan Nelson (Unclaimed Profile)
Criminal Law lawyer at Nelson & Lawless
The ONLY specific advice you can expect to get from here or elsewhere is to exercise your 5th Amendment rights to SHUT UP, and hire an attorney to speak for you. That applies in criminal charges, as well as administrative matters like yours where you face serious consequences such as license revocation. 95% of people convict themselves by trying to be 'helpful and cooperative'. Unless you know how to effectively represent yourself in this, hire an attorney who does. If this is in SoCAL, and youre serious about hiring counsel, feel free to contact me.
