Can I fight an MIP charge if I was not drinking or under the influence?

Michael Lawrence Chastaine
Answered by attorney Michael Lawrence Chastaine (Unclaimed Profile)
Criminal Law lawyer at Chastaine Jones
Short answer is yes you have a chance of winning. I would want to see the reports. This sounds like the type of case that might not be charged by the DA.

What are the consequences of having a BAC of .18 in Los Angeles?

default-avatar
Answered by attorney Terry Alan Nelson (Unclaimed Profile)
Criminal Law lawyer at Nelson & Lawless
What are the consequences of having a BAC of .18 in Los Angeles? The same as anywhere else in CA, enhanced penalties upon conviction, since that is more than double the legal limit. You face up to a year in jail, plus all the other penalties you've heard about. The honest answer is that no attorney can predict the outcome, nor even give an intelligent opinion, without reviewing and knowing all the charges, evidence, police reports, expected testimony, priors history, etc. With all that said, if you have no prior DUI convictions, and there was no accident or injury involved, your attorney may be able to keep you out of jail on this with a plea bargain. Unless you go to trial and win an acquittal, you face thousands of dollars in fines and court costs, suspension of license, alcohol programs, etc. You are always entitled to represent yourself in court. Whether you should is a different issue. The conventional wisdom is that an attorney will be able to do a better job and get a better outcome. Prosecutors and judges don't like dealing with ProPers, unless you are simply pleading guilty, not defending the case. A little free advice: When arrested for DUI, whether alcohol or drugs, then upon release from jail or booking the defendant is given documents that include a notice that you have only ten days to file a request with DMV for a hearing on an appeal of the automatic suspension of your license imposed by DMV upon your arrest. That is separate and runs consecutively with any suspension that may be imposed by the DMV, or the court upon conviction. Contact DMV and do so, timely if you think you have grounds for appeal, then appear at your scheduled DMV appeal hearing and present any supporting evidence and testimony. If you don't know how to do these things effectively, then hire an attorney that does. When charged with any crime, the proper questions are, can any evidence obtained in a test, search or confession be used against you, can you be convicted, and what can you do? Raise all appropriate defenses with whatever witnesses, evidence and sympathies are available for legal arguments, for evidence suppression or other motions, or for trial. If you don't know how to represent yourself effectively against an experienced prosecutor intending to convict, then hire an attorney who does, who will try to get a charge reduction, diversion, program, or other decent outcome through plea bargain, or take it to trial if appropriate. If serious about hiring counsel to help in this, and if the charges are in SoCal courts, feel free to contact me. I'll be happy to help fight this and get the best outcome possible, using whatever defenses there may be. Fees will have to be discussed and agreed upon, but mine are within the range of "normal" and comparable to other attorneys.

Can a Non-Violent Felon move into my home if I own a firearm?

default-avatar
Answered by attorney Craig W Elhart (Unclaimed Profile)
Criminal Law lawyer at Craig W. Elhart, PC
A convicted felon cannot be in possession of a firearm. She would have to make sure that she was not in possession. If she was in your home and knew the gun was there, she may have a problem. Since the conviction is over 5 years old and if it is the only conviction, why not move for expungement?
