You need a good lawyer. You committed fraud which is a felony. You could potentially go to prison. You need to get the restitution together quickly and hire a great lawyer.

If the cop never gave me any statement of fact or police report can the case be thrown out?

Unfortunately no. Your lawyer will know how to obtain whatever is necessary. If you are not going to use a lawyer, you should be able to go to the Clerk's office and get copies of the police report and/or incident reports. However, you really should consider hiring an attorney. At this early stage in the proceedings, you may have an opportunity to have the matter dismissed before a criminal complaint issues. Beyond the obvious benefit that if no complaint issues you will have no CORI entry, it is also less expensive for legal counsel at a Clerks Hearing than once the complaint issues. At least I charge less since the whole process is complete on one day whereas with a Criminal Complaint, it may take several court appearances before disposition is reached.

What can be done if my husband violated his probation this is his first time and it was because we forgot to tell them we moved it?

Anthony O. Van Johnson

Your husband should retain an attorney. An attorney can negotiate with the probation officer and prosecutor to seek to have the probation reinstated. Or, in the alternative, the attorney can petition the court for reinstatement.
