You should have already hired an attorney. A DUI is something that is too serious to try to defend yourself. If you haven't hired an attorney yet, you certainly need to hire one now. A Failure To Appear has likely been added to your charges and a warrant issued for your arrest. An attorney can probably help alleviate some of that.

If someone is handcuffed do they need to be read their Miranda Rights?

It appears that being handcuffed assumes that the individual is under arrest, however, Miranda only has to be given if the police attempt to use a post-arrest statement against the individual. The lack of Miranda therefore does not result in a dismissal of the charges but is critical if there is a statement made by the accused.

Unless you were the victim you probably do not have a claim. You cannot file a lawsuit on behalf of another adult. I'm not sure from your facts as to how the person who died may be related to you. The estate of the deceased person may have a cause of action but then there may be an issue of recovery even if they obtained a verdict.
