i would first determine if one could get back into drug court. we have had good fortune with getting people back into drug court if they follow our plan. if not, the sentences can be most harsh. the sentences should be run concurrently. i would need to see the entire file to determine if we can be helpful. however, my initial thought is that on e should avoid the 'parole stipulation' of two [2] years. this will surely delay parole. please let me know if we can help. ed dimon, esq. 732-797-1600

If the police report said we had no grounds to stop him, I would be shocked. The report details exactly why they stopped him. You may disagree, or claim they lied, but the report is the basis of any criminal charges. Apparently, he consented to a search. A little free advice he should have taken at the time: exercise the 5th Amendment right to SHUT UP and do NOT talk to police or anyone about the case except with and through an attorney. When questioned, arrested or charged with any crime, the proper questions are, can any evidence obtained in a test, search or statement be used against you, can you be convicted, and what can you do? Raise all appropriate defenses with whatever witnesses, evidence and sympathies are available for legal arguments, for evidence suppression or other motions, or for trial. No amount of free 'tips and hints' from here or elsewhere are going to effectively help in a legal defense. If you don't know how to represent yourself effectively against an experienced prosecutor intending to convict, then hire an attorney who does, who will try to get a dismissal, charge reduction, diversion, programs, or other decent outcome through motions, plea bargain, or take it to trial if appropriate.
