Is it legal for an attorney to offer a plea bargain to the accused without them seeing the motion of discovery?

Answered by attorney Lawrence Lewis (Unclaimed Profile)
Criminal Law lawyer at Lawrence Lewis, P.C.
It is legal. First of all, you don't even know what you are asking for. The motion for discovery is a motion that the attorney files with the court. You can go and request the court file and examine the motion for discovery at anytime. You need the actual discovery (police report, photos, 911 calls, etc.) Because you are such an idiot, the attorney chooses to spend as little time with you as possible. The attorney does not need to show you anything before discussing the plea offer with you, PERIOD. Now you can go and retain your own attorney.

What legal steps can we take if my mother is a victim of identity theft?

The first thing she needs to do is file a police report immediately. Then she needs to speak with either a certified public accountant or tax attorney regarding how to handle the 1099-C.

What are the possible penalties that my mother could be facing if she allegedly stole 3 guns and charged with burglary of a dwelling?

Answered by attorney John F Brennan (Unclaimed Profile)
Criminal Law lawyer at Musilli Brennan Associates, PLLC
She is a very significant trouble, needs a attorney or certainly, at least, an attorney assigned it to her and her case. In the meantime she should speak with no one until she has received counsel. Burglary of a dwelling place is a felony, and the theft of firearms considered very serious. If she is also being accused of taking pills or medications, I would suspect that you may have a substance abuse problem and you should be intervening as soon as possible.
