The home invasion charge is certainly going to be a violation of your probation and 7411, and the fact you committed it while on probation is not going to be seen as at all favorable by the court. You are very likely facing jail time. Get a good attorney.

Can a restraining order be nullify?

A lawyer cannot "cancel" a restraining order, whether you are there or not. If the person requesting the order appears and asks the judge to issue it and you are not there to defend yourself, so long as the allegation meets the statutory requirements, 1) relationship and 2) fear of imminent bodily harm, then the judge will have no choice but to issue the order. I don't know what the lawyer said or did, but you should certainly speak to him/her and make sure you are clear on exactly what took place and what he/she will do from this point forward.

A Judge can only dismiss a case if it is in front of him/her for a trial. A Judge would not just dismiss a case solely because the person is joining the military so you need to have an attorney help you. Contact an attorney immediately to help you with your idea.
