Is possession of stolen property a felony or a misdemeanor?

Jared Clayton Austin
Answered by attorney Jared Clayton Austin (Unclaimed Profile)
Criminal Law lawyer at Austin Legal Services, PLC
If you receive or conceal stolen property or aid someone in receiving or concealing stolen property, it could be either a felony or a misdemeanor. It depends on the value of the property. If the value is less than $200, it's a 93-day misdemeanor. If the value is $200 to $1,000, it's a one-year misdemeanor. Beyond that value, you started getting into felony classification which again, depends on the value of the property. In order to be convicted you have to know or have reason to know (i.e. you should have known) that the property was stolen.

What happens to if I had been caught by store employee because he said I did not pay all the items?

Cynthia Russell Henley
Answered by attorney Cynthia Russell Henley (Unclaimed Profile)
Criminal Law lawyer at Cynthia Henley
You could receive a citation (ticket) in the mail but more likely you will receive a notice to appear in a county level court. Do not ignore this letter or a warrant will issue for your arrest. It is a class B misdemeanor offense based on the information you provided. You will need a lawyer. And, you do not want to take a final conviction as theft is a crime of moral turpitude. You will also likely receive a demand letter from a lawyer who represents the store. It is a civil demand which is separate from a criminal charge. If you do not pay it, then they would have to sue you to recover (and it would cost them more than they could recover.) Whether you pay it or not, it will not affect your criminal case.

Can inmate get reinstated for probation after a four year run?

In theory, yes, but in practice no. He is going to do some time. Absconders are not treated nicely by courts.
