Don't plead to anything without legal representation!!! You could serve anything from no time up to a year in jail if it's a misdemeanor - or it could be charged as a felony. You're also looking at a mandatory year-long counseling program, lifetime ban on firearms, protective orders, etc. You absolutely need an attorney. Either find a good local criminal defense attorney or apply for the public defender when you go to court. I'd strongly suggest hiring an attorney if you can so they can be prepared for your very first appearance in court. It may make the difference between a restraining order being issued, bail being set, etc.

Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. Although 14 months is a long time, if the defendant waived his right to a speedy trial, either personally or through his attorney, the case can go on until everyone is ready. The defendant should be talking to his attorney about this, or if he is not happy with his present attorney, then he should contact another experienced criminal defense attorney for a face-to-face consultation and give him/her all of the facts surrounding his case. He/she would then be in a better position to analyze his case and advise him of his options.

The Police should send a copy of their report to the DA's office. From there the case will be evaluated and the decision to file charges, or not, will be made. If charges are to be filed you would be sent a letter. If that happens consult with an attorney.
