Can i get a misdemeanor theft charge expunged or sealed

Answered by attorney Patrick Short
Criminal Law lawyer at Law Firm of Patrick Short
In general, if you have been released and the charge, if any, has not resulted in a final conviction and is no longer pending and there was no court-ordered community supervision under 42.12 of the Texas Code of Criminal Procedure, unless the offense is a Class C misdemeanor. You would need to consult with an attorney to file the proper motion and determine if you are entitled to expunction.

Can I pay off my felony charge without doing time in jail? How?

No. You have a warrant for your arrest and you will have to go in front of the judge to determine your punishment. You signed a document that you understand that if you do not follow all the conditions of probation you are subject to the full range of punishment. Go and consult with a local criminal defense attorney. He or she can give you a better idea of what the particular judge might do. Good luck.

How much do you think my fine will be for theft first offense?

You should not be worried about the fine. You should be worried about keeping a crime of moral turpitude off your record. A class B misdemeanor is punishable by up to a 2000 dollar fine and 180 days in jail. Assuming this is your first criminal charge, it will not be even close to a 2000 dollar fine.
