What if the victim doesn't show up for court will the judge drop the case?

Answered by attorney Steven Joseph Pisani (Unclaimed Profile)
Criminal Law lawyer at The Law Offices of Steven J. Pisani, LLC
The DA has the burden of proof in a criminal case. If their victim/witness does not show up for court, they may be forced to dismiss the case because they cannot prove the charges. In some cases, the DA can still proceed with some or all of the charges based on other evidence and other witnesses. Additionally, if the witness was subpoenaed and fails to appear, the court will likely continue the case to a later date and issue a warrant for the witness.

Do I have grounds to file a restraining order or a harassment order?

Answered by attorney Jonathan S. Willett
Criminal Law lawyer at Jonathan S. Willett Attorney at Law
For a customary restraining order, any threat of physical violence has to be imminent, in other words, the person must have the ability to carry it out right then. If your divorce is still pending, I would bring the matter to the attention of the divorce judge and ask if he/she would issue an order. The harassing phone calls sound like criminal harassment. If the divorce judge doesn't do anything, I would suggest calling the police. If they file a charge, a restraining order as a part of the charge is automatic.

Can I be stopped at a DUI road block with no probable cause? How?

Criminal Law lawyer at Law Office of Robert E. McCall
Of Course. Feds have authorized road blocks for sorts of things (DUI, Illegal aliens). They can ask questions and sometimes may search the car/truck.
