How can I file request for dismissal regarding traffic citation in which all audio/video requested was destroyed?

Answered by attorney Jonathan S. Willett
Criminal Law lawyer at Jonathan S. Willett Attorney at Law
Tell the court that due to their destruction of evidence, they have violated your constitutional right to due process of law in that they destroyed evidence that was exculpatory and would have shown your innocence. Also, due to their destruction of evidence, you cannot properly defend yourself.

If I was not read my rights before or after I was arrested can that drop the charges?

Answered by attorney Jonathan Hackworth
Criminal Law lawyer at Hackworth Law P.A.
No, that would not result in the charges being dropped. Ultimately, it will only result in any statements being suppressed. Additionally, there are many specifics regarding when someone is required to advised of their Miranda rights.

Is it too late to hire a lawyer if I was arrested for possession of controlled substance two years ago?

Answered by attorney Robert Jason De Groot (Unclaimed Profile)
Criminal Law lawyer at R. Jason de Groot, P.A.
Too late to hire an attorney for what? To deal with all the things you have to put up with after you entered a plea. It is too late to revisit the criminal case, but not too late to be there for you and write demanding letters to whoever you need to make demands upon.
